Appellate Webinar Series, Session 8: The Great Divides – Identifying Federal Criminal Defense Issues Currently Splitting the Circuits
Ever identify a circuit split only to find out the split had been resolved? Or wished you had preserved a split long after your case had closed? We’ve all been there. Wouldn’t it be nice to have a training session designated to reviewing unresolved circuit splits so that you can effectively exploit these gaps in the law to benefit your client? We thought so, too.
In this webinar, we will review many of the federal criminal issues that are currently dividing the courts and discuss the preservation of these issues for potential appeal. We will identify circuit splits related to the issues you see most: searches and seizures, defendant statements, immigration, standards of review, the Sentencing Guidelines, and more. After this webinar, you will be able to recognize many of the current criminal defense issues dividing the Courts of Appeals so that you can use (and preserve) these issues to vigorously defend your clients.
Presenter Biography
Tracy DaCruz, Esq. is currently an Appellate Attorney with the Office of the Federal Defender, Northern District of Alabama. Previously, she spent over seven years as a Research and Writing Specialist and Assistant Federal Public Defender in the Middle District of Florida. Tracy also previously practiced as a solo practitioner where she handled federal and Florida appellate and post-conviction litigation.
George Couture joined the Defender Services Training Division in September 2017 after chasing unicorns for six years in the United States Court of Appeals for the Eleventh Circuit as a career law clerk to the Honorable Beverly B. Martin. Before that, George enjoyed the privilege and honor of representing indigent criminal defendants in state and federal court for close to two decades as an Assistant Federal Defender in the Eastern District of California and the Middle District of Florida, and capital trial and post-conviction public defender with the State of Florida.
CLE Applicable Event
VIRTUAL PROGRAM:
This is a virtual program. Defender Services Office Training Division, (DSOTD), generally seeks CLE accreditation for participants and faculty attending virtual programs. CLE for this program will be sought in all applicable jurisdictions. However, actual CLE approval is at the discretion of each bar association/organization. Notably, you must attend the entire virtual program to receive full CLE credit. To minimize reporting fees per attorney/program, if you are barred in more than one of the following states: NM, TN, PA, NE, attendance will be reported to one state only. Attorneys are responsible for making sure the appropriate state and bar number is on file with DSOTD. For states that require DSOTD to report attendance, attendance will be reported using the bar number(s) and state(s) listed on the registration form submitted for this virtual program. Failure to provide a state and bar number may result in DSOTD not being able to report your attendance. Within 30 days of the completion of this virtual program, DSOTD staff will send attendees a post program email with a CLE information sheet detailing the amount of CLE credit approved by each state, a uniform certificate of attendance and a program agenda.
