In Alabama, certain sex offenders cannot ever spend the night in the same home as a child even if the offense was years ago, they are reformed, and the child is their own. Unanimous Eleventh Circuit: This violates the fundamental right to establish a home, as articulated in totally rad cases like Meyer v. Nebraska (1923). Alabama has not narrowly tailored its law and "deprives some children in Alabama of the presence of a parent who may be fit to lovingly care for and raise them."

The case is Henry v. Sheriff of Tuscaloosa, Alabama, No. 24-10139 (11th Cir. April 23, 2025).
