Florida Federal Court Blasts Prosecutors in Habeas Case

A federal judge in Orlando issued an order this week admonishing the United States Attorney for the Middle District of Florida, but stopped short of imposing sanctions according to Law260 article.

The court's admonition of Gregory Kehoe and Assistant U.S. Attorney Joy Warner is the latest entry in the docket of Javier Gimenez Rivero.

The court ruled in January that Gimenez Rivero, a high-school student brought to the United States from Venezuela as a minor, was unlawfully detained. In his order releasing Gimenez Rivero, the court criticized the federal government’s attorneys for not including contrary law in their arguments.

"In this district alone, [U.S. Immigration and Customs Enforcement] has falsified warrants, and deported American citizens, and defied no-transfer orders. These violations are widespread," the court wrote in a text order.

"The government's attorneys cannot allow an imperious client to separate them from their professional obligations. The court expects them to practice ethically even in unprecedented times," the court added.
