A forthcoming law review article by Eve Hannan, Remorse Bias, 83 Missouri Law Review 2 (forthcoming 2018), examines scholarship on the role of remorse in criminal sentencing and social science research on implicit racial bias.  Hannan argues that “unconscious cognitive assumptions about race and criminality causes judges to discredit African American displays of remorse and, as a consequence, sentence them to harsher punishments.”  The full abstract and article are available at SSRN here.
