Justice Department Orders Random DEA Airport Searches Stopped

Published on: Friday, November 22, 2024

The Department of Justice (DOJ) announced that the DEA will cease its "cold consent encounters" at airports, during which agents demand to search people's bags while telling them things like, "I don't need your consent." The suspension coincides with an inspector general report condemning the practice (article available here).

The directive from the deputy attorney general to the U.S. Drug Enforcement Administration (DEA) orders that it suspend “all consensual encounters at mass transportation facilities unless they are either connected to an ongoing, predicated investigation involving one or more identified targets or criminal networks or approved by the DEA Administrator based on exigent circumstances.”

The management advisory memorandum was issued by DOJ Inspector General Michael Horowitz.
