Webinar: Strategies For Defending Noncitizens: Immigration Guidelines
STRATEGIES FOR DEFENDING NONCITIZENS: IMMIGRATION GUIDELINES -- YA LO PAGUÉ: CALCULATING SENTENCING ENHANCEMENTS UNDER THE REBOOTED SECTION 2L1.2.
Failing to identify sentencing issues and object will cost your client time in custody. Now that the revamped immigration guidelines have been in effect for over a year it's time to review sample cases which the United States Probation Officers ("USPO") more often than not simply get wrong. The probation officers calculate certain enhancements in a manner that will cause your clients to spend more time in custody if you don't identify the issues and object to the enhancements in your sentencing position. After participating in this webinar you will be able to correctly calculate the advisory guideline enhancements for prior sentences imposed upon your client involving revocation, suspended and consecutive sentences. You will be able to determine how enhancements are applied when your client has an arrest and is removed before the imposition of a sentence. You will learn the new rules about timed-out convictions which do not receive criminal history points. After you participate in this webinar you will be able to win at sentencing for your noncitizen clients.
