(In response to the rule articulated in Montejo v. Louisiana, 129 S. Ct. 2079 (2009), counsel may wish to consider filing an assertion of 5th and 6th Amendment rights form at all initial appearances. The above form is designed for the attorney's and the client's signatures. Once filed with the court, counsel should place on the record verbally that the client asserts his 5th and 6th Amendment rights, and that, by the act of filing the form, both the AUSA and the case agent have been notified of the assertion of rights and are not to contact client except through counsel. )
