The Department of Justice/Administrative Office Joint Working Group on Electronic Technology (JETWG) has developed a recommended ESI protocol for use in federal criminal cases.The primary purpose of the ESI protocol is to facilitate more predictable, cost-effective, and efficient management of electronic discovery and a reduction in the number of disputes relating to ESI.

This guidance om Deputy Attorney General James Cole provides an expansive definition of who is part of a "prosecution team" for discovery purposes, requires that all electronic communications between law enforcement and civilian witnesses be preserved and reviewed for disclosure, and places the burden on the prosecutor involved in the case to ensure that all law enforcement know to preserve all communications.
